Respondents PRAYER: Petition under Article 226 of the Constitution of India for issuance of a writ of Mandamus directing respondents 1 to 3 to remove the encroachment made by the fourth respondent in S.No.73/4, Paachal Village, Namakkal Taluk by taking action as per Section 6(2) of the Tamil Nadu Land Encroachment Act, 1905, which is covered under the notice of the 3rd respondent dated 10.8.2016 issued under Section 7 of the said Act.

ORDER

(Order of the Court was made by the Hon'ble Chief Justice) We see no reason to interfere in the matter as the respondent authorities have already triggered off action by issuing notice under Section 7 of the Tamil Nadu Land Encroachment Act, 1905 and on receiving the reply in respect thereof from the fourth respondent, will naturally pass orders in accordance with law under Section 6 of the said Act.

2. The petition is dismissed with the aforesaid observation. No costs.
