Plaintiff Prayer: Memorandum of Second Appeal filed under Section. 100 of C.P.C. against the judgment and decree of dismissing appeal in A.S.No.40 of 2011 dated 03.01.2017 passed by the Subordinate Judge, Tambaram by confirming the decree and judgment passed by the District Munsif, Tambaram in O.S.No.178 of 2004 dated 28.01.2009 by allowing this appeal thereby to pass a decree and judgment in favour of the appellants.

J U D G M E N T

This Second Appeal filed under Section. 100 of C.P.C. against the judgment and decree of dismissing appeal in A.S.No.40 of 2011 dated 03.01.2017 passed by the learned Subordinate Judge, Tambaram by confirming the decree and judgment passed by the learned District Munsif Court, Tambaram in O.S.No.178 of 2004 dated 28.01.2009 by allowing this appeal thereby to pass a decree and judgment in favour of the appellants.

2. The learned counsel appearing on behalf of the appellants has sought leave to withdraw the second appeal vide letter dated 06.03.2020. It is also accompanied by a letter from the appellant to one of the counsel on record for the appellant https://hcservices.ecourts.gov.in/hcservices/

instructing him to withdraw the appeal.

3. In view of the same, this appeal is dismissed as withdrawn. No costs. Consequently, connected miscellaneous petition is closed.
