Petitions filed under Article 226 of the Constitution of India praying for issue of Writ of Mandamus (i) WP.5481/17 - to direct the respondents to consider the enhancement credit limit proposal either by accepting the additional collateral security offered by the petitioner or in the alternative to take over the management of the petitioner company in consonance with the provisions of the Sarfaesi Act without prejudice to the rights of the petitioner; and (ii) WP.5631/2017 - to direct the respondent Bank to consider the One Time Settlement offer made by the petitioner company.

By order dated 24.08.2018, the Registry was directed to send drafted notice to the petitioner. Pursuant to the same, the Registry sent a drafted notice to the petitioner. However, the drafted notice sent to the petitioner returned with an endorsement "vacated". Hence, this Court directed the Registry to print the name of the petitioner. Accordingly, when the petitions were taken up on 29.11.2018, the name of the petitioner was shown in the cause list, however, none appeared for the petitioner on that date. Therefore, this Court directed the Registry to list the petitions under the caption 'for dismissal' on 04.12.2018, i.e., today.

2.Today also, though the name of the petitioner is printed in the cause list, none appears for the petitioner. Hence, this Court has no other option except to dismiss the writ petitions for non-prosecution.

Accordingly, the writ petitions are dismissed for nonprosecution. Consequently, W.M.P.No.6016 of 2017 in W.P.No.5631 of 2017 is also dismissed.
