This Court while passing an order on 01.02.2021, directed to list this matter for filing action taken report.
2. Today, when the matter is taken up for hearing, the Deputy Commissioner of Police, Central Crime Branch-II, Greater Chennai, filed a status report, wherein it is stated that the Deputy Commissioner of Police conducted personal enquiry and found that the alleged amount has not been seized by the Investigating Officer/Inspector of Police, G.S.Premananth and also not settled to the de-facto complainant. It is further stated that G.S.Premananth, Inspector of Police is acted in accordance with law and there is no lacuna on the part of the investigation done by him.
3. However, the learned counsel for the petitioner would submit that the respondent police forced the petitioner to hand over the money to Page No.1/4
the de-facto complainant. He would further submit that there is an allegation against G.S.Premananth, who forced the petitioner to hand over the money to the de-facto complainant stating that the amount has been recovered and simply closed the case. He further submitted that the petitioner gave a sum of Rs.1,16,00,000/- by way of Demand Drafts and a sum of Rs.1,86,500/- by way of cash to the de-facto complainant in the presence of Investigating Officer under the impression that the amount would be lying with the Court.
4. Since the grievance of the petitioner is that the said G.S.Premananth, forced him to pay the money to the de-facto complainant, it is open to the petitioner to give a private complaint against the concerned police before the concerned Magistrate Court in the manner known to law. If any private complaint is given, the concerned learned Magistrate is directed to deal with the same in accordance with law.
