ORDER
The writ petition is filed for the below relief: directing the respondents to settle the amount as admitted by the 2nd respondent in the communication dated 16.12.2024 under the Right to Information act towards the Encashment of Earned Leaves, surrendered by the petitioner along with 12 percent interest per annum.
2. The brief facts which are culminated in the filing of this writ petition are set out below:
2.1 It is the case of the petitioner that he had been appointed as a Driver in the respondent Transport Corporation. He attained the age of superannuation on 30.11.2012. Despite having retired, the terminal benefits were not settled to
the petitioner immediately and has not been settled to date. The amount due towards earned leave which have been surrendered by the petitioner also had not been settled to the petitioner. Hence, the petitioner had made an application under the Right to Information Act, by asking how many days and months are due and the amount to be paid by the respondent. In response to his application, the communication dated 16.12.2024 had been received from the respondent with the following details.

3. Despite acknowledging that the petitioner is entitled to the amount mentioned above, the respondent has not come forward to clear the dues. Therefore, the writ petition.
4. Heard the learned Counsels on either side and perused the records.
5. On perusal of the papers, it is evidently clear that the petitioner is
entitled to amounts mentioned above. Therefore, a mandamus is issued to the respondents to settle the amount, as admitted by the 2nd respondent in the communication dated 16.12.2024 towards the encashment of earned leave surrendered by the petitioner along with 6% interest per annum.
6. Accordingly, with the above directions, the writ petition is allowed. No costs.
