ORDER : The Court Made the following order :- The petitioner who was arrested and remanded to judicial custody on 12.10.2021 for the offences under Section 409, 420, 506(i), r/w 34 of I.P.C.in Crime No.175 of 2019, on the file of the respondent police, seeks bail.

2. The case of the prosecution is that the petitioner along with other accused cheated the defacto complainant and others under the guise of giving high returns to the investors viz., for investment of Rs.1 Lakh, they would give Rs.1,900/- per day for 100 days. Further, when the defacto complainant had asked for the money, the accused have threatened him with dire consequences. Hence, the complaint.

3. The learned counsel for the petitioner/A3 would submit that the petitioner was working as Assistant under A1 and he is no way connected with the alleged offence and he has been falsely implicated in the above case. He would further submit that the main accused A1 and A2 have been released on statutory bail and the petitioner has been suffering incarceration https://hcservices.ecourts.gov.in/hcservices/

for more than 71 days from 12.10.2021. Hence he would pray for grant of bail to the petitioner.

4.The learned Government Advocate (Crl. Side) raised strong objection stating that nearly 267 complaints have been received against the petitioner and others and the amount involved is more than Rs.3.35 Crores and that the investigation has not been completed and if the petitioner is released on bail, there is every possibility of the petitioner tampering the evidence.

5.On seeing the nature of allegations in the FIR and the fact that the amount involved in more than Rs.3.35 Crores and that the police have received more than 260 complaints so far against the petitioner and other and that the investigation has not been completed. Under these circumstances, if the petitioner is released on bail, there is every possibility of the petitioner tampering the evidence and hence, this Court is not inclined to grant bail to the petitioner. Accordingly, this Criminal Original Petition is dismissed.
