(Previously Palladam Taluk), Tiruppur District comprised in S.No.505 before surveying the land and pass appropriate orders on merits after affording opportunity to both parties within a particular time frame to be fixed by this Court.

ORDER

By consent of learned counsel on both sides, this writ petition is taken up for final disposal at the admission stage itself. In view of the order that this Court proposes to pass and also, the limited relief that is sought to be granted, notice to respondents 4 to 6 is dispensed with.

The present writ petition is filed for a writ of mandamus to direct the 2nd respondent to consider the petitioner's Objections dated 09.06.2025 & 22.07.2025 before surveying the land comprised in S.No.505 situated at Semmandapalayam Village, Sulur Taluk (Previously Palladam Taluk), Tiruppur District and thereafter, pass appropriate orders on merits after affording opportunity to both parties within a particular time frame to be fixed by this Court.

Considering the above facts and circumstances of the case and having regard to the submission made by the learned counsel on both sides, this Court is inclined to dispose of this writ petition on the following terms: (i) The survey proposed to be conducted by the respondents 2 & 3 in the agricultural property comprised in S.No.505/1 measuring an extent of 1 Acre situated at Semandampalayam Village, Sulur Taluk, Coimbatore District on 08.08.2025 shall be kept in abeyance. (ii) The respondents 2 & 3 are directed to conduct survey in the agricultural property comprised in S.No.505/1 measuring an extent of 1 Acre situated at Semandampalayam Village, Sulur Taluk, Coimbatore District, after considering the Objections dated 09.06.2025 & 22.07.

2025 submitted by the petitioner and also, after issuing notice and affording an opportunity of personal hearing to the petitioner, respondents 4 to 6 and all other interested parties including rival claimants, if any, within a period of eight weeks from the date of uploading of the web copy of this order without waiting for the receipt of a certified copy of this order. (iii) It is made clear that this Court has not expressed any views with regard to the merits of the case and it is open to the concerned respondent to consider the matter on its own merits and in accordance with law.

and contentions of the petitioner and all other interested parties are left open.

4. There shall be no order as to costs. Consequently, connected Miscellaneous Petition is closed.
