The Application has been filed seeking permission to produce additional documents on behalf of the plaintiff. 2.The documents have been listed out in the Judges Summons and they are letters from the parents of the plaintiff to the plaintiff and photographs of the plaintiff with his parents and also photographs of the son of the plaintiff showing a sweater knitted by the mother of the plaintiff. 3.It is pointed out by the learned counsel for the defendant that these documents are actually prior to the institution of the suit, and could have been filed along with the suit itself.

4.But however, a perusal of the affidavit filed in support of the Judges Summons gives out necessary reasons for filing the documents. It is stated that these documents are required consequent to the written statement filed by the defendant, wherein various allegations have been stated by the defendant and to controvert such allegations, these documents are required. https://www.mhc.tn.gov.in/judis

smv 5.Taking a broader view that in any civil litigation parties must be given an opportunity to tender evidence and while tendering evidence they must also be granted an opportunity to produce documents to substantiate their respective cases, provided the documents are admissible in nature, are relevant and are proved in manner known to law, this Application is allowed. No costs.
