A.No.4818 of 2022 in C.S.No.177 of 2021 C.V.KARTHIKEYAN, J.

The plaintiff has filed the present application. The suit had been filed against his own brother seeking declaration that various Settlement Deeds, which have been registered as null and void and for accounts relating to the estate of the mother and father of the plaintiff and the defendant and also for costs of the suit.

2.In the short cause title and in the long cause title, the plaintiff had given a particular address at Missouri, U.S.A. Now by the present application, the plaintiff has disclosed information that he has shifted his address to Kansas City, U.S.A and therefore, necessary amendment is required to be carried out in the short cause title, long cause title and in the statement of address to the plaint. But I hope that the plaintiff does not, as an habit shift his address. The plaint should not or need not be amended, if the plaintiff is able to give a permanent address. The plaintiff should ponder over that particular aspect.

smv 3.With respect to present shift, I would, to facilitate service of notice or for every other practical purpose, permit the request to change the address of the plaintiff in the short cause title, long cause title and in the statement of address and also wherever, the plaintiff had described himself along with the address. This Application is allowed.

4.This order is passed in the presence of the learned counsel for the defendant who had stated there has actually been a shift in the address, but who also pointed out that it would only be appropriate that the plaintiff gives a permanent address, so that such an application is not filed again in future. 15.11.2022 (1/3) smv A.No.4818 of 2022 in C.S.No.177 of 2021 https://www.mhc.tn.gov.in/judis
