.... Respondents Prayer:-Petition filed under Article 226 of the Constitution of India praying this Court to issue a writ of mandamus, directing the 1st respondent to complete the disciplinary proceedings within 2 months against the petitioner as sought by representation dated 17.08.2022.

The petitioner seeks for early completion of the disciplinary proceedings initiated against him by the first respondent. The petitioner has sought for completion of 1/4

the disciplinary proceedings within a period of two months and has also given a representation dated 17.08.2022 to the first respondent for the said purpose.

2. Heard Mr.N.A.Nissar Ahmed, learned counsel for the petitioner and Mr.L.S.M.Hasan Fizal, learned Additional Government Pleader accepts notice on behalf of the respondents. By consent of both the parties, the main writ petition has been taken up for final disposal.

3. The petitioner claims that despite a direction of this Court in WP No.8542 of 2018 dated 12.07.2018, Charge Memo was issued to the petitioner on 06.01.2022. In such circumstances, the petitioner seeks for completion of enquiry proceedings within a period of two months.

No prejudice would be caused to the respondents if such a direction is issued and this Court is of the considered view that two months period is too short to complete the enquiry proceedings and a direction can be issued to the respondents to complete the enquiry proceedings within a period of three months.

5. For the foregoing reasons, this Court directs the first respondent to 2/4

complete the disciplinary proceedings against the petitioner within a period of three months from the date of receipt of a copy of this order. It is made clear that the petitioner shall cooperate in the enquiry proceedings to enable the first respondent to conclude the proceedings within a period of three months.
