ORDER
This Criminal Original Petition has been filed by the petitioner to direct the respondents 1 and 2 to give police protection to petitioner's life and limb and consider the petitioner's representation dated on 08.05.2025.
2. The case of the petitioner is that on earlier occasion, the petitioner was attacked by some of the private respondents herein and hence, the petitioner had lodged a complaint before the Poolampatti Police Station, Salem District. The same was registered in Crime No.149 of 2019 for the offences under Sections 294(b), 324 and 506(ii) IPC and subsequently after completion of investigation, the charge sheet was filed and the same was taken on file in 2/7
C.C.No.92 of 2022 on the file of the District Munsif cum Judicial Magistrate, Edappadi, Salem District and the same is pending. While so, on 20.03.2025, the private respondents herein attempted to attack the petitioner. Hence, the petitioner made a complaint before the Superintendent of Police, Salem, however, no action was taken. Once again on 06.05.2025, the private respondents herein abused him in filthy language and also gave life threat to the petitioner. Therefore, the petitioner made a representation to the respondents police herein on 08.05.2025 seeking police protection. But the same has not been considered so far. Hence, the present petition is filed.
3. Heard the learned counsel for the petitioner and the learned Government Advocate (Crl. Side) appearing for the respondents police and also perused the materials available on record.
4. According to the learned Government Advocate (Crl. Side) appearing for the respondents 1 and 2, there is only a pathway dispute between the parties. However, a perusal of the representation of the petitioner shows that 3/7
the petitioner had not made the said representation for protection to use the pathway. In the representation, the petitioner has clearly stated that there is a life threat to the petitioner by the private respondents herein. Further, it is seen that already a case has been registered against some of the private respondents herein for the offence under Section 324 of IPC in Crime No.149 of 2019 on the file of the Poolampatti Police Station, Salem, for physically attacking the petitioner.
5. Under these circumstances, the respondent police is directed to give police protection to the petitioner.
6. Further, the earlier complaint registered in Crime No.149 of 2019 on the file of the Poolampatti Police Station, is pending for more than 6 years in C.C.No.92 of 2022 and since there is a life threat to the petitioner, the District Munsif cum Judicial Magistrate, Edappadi, Salem District, is directed to dispose of the said case in C.C.No.92 of 2022 within a period of six months from the date of receipt of a copy of this order. 4/7
7. The Inspector of Police, Poolampatti Police Station, is directed to produce the witnesses before the trial Court without any further delay and cooperate with the trial Court for the disposal of the case in C.C.No.92 of 2022 within the time as stipulated by this Court.
8. With the above directions, this Criminal Original Petition is disposed of.
