The present criminal original petition has been filed seeking direction to the third respondent police to register the complaint under sections 147, 148, 294(b), 447, 426, 506(ii) of IPC r/w. section 4 PPD Act based on the petitioner's complaint dated 11.08.2015 to the third respondent Police and representations sent by the petitioner dated 12.08.2015 and 17.08.2015 to the first and second respondent police.
2. The petitioner has lodged a complaint as against one Mukan Son of Natasa Mooper and 15 others on the allegation that they abused and threatened the petitioner with dire consequences and they had broken fifteen PVC pipe lines in the petitioner's property, in respect of the land dispute between them. Though C.S.R.No.237 of 2015 has been assigned on the complaint of the petitioner, no action has been taken on the said https://hcservices.ecourts.gov.in/hcservices/
complaint till date. Hence, the petitioner has come forward with the present criminal original petition.
3. I have heard the learned counsel appearing for the petitioner as well as the learned Additional Public Prosecutor appearing for the respondent.
4. The learned Additional Public Prosecutor submitted that on receipt of the complaint of the petitioner, C.S.R.No.237 of 2015 has been assigned and the matter is pending for enquiry.
5. In view of the submissions made on either side, this Court directs the third respondent to conduct enquiry on the complaint given by the petitioner dated 11.08.2015 in C.S.R.No.237 of 2015 and dispose the same in accordance with law as early as possible.
