ORDER

This Criminal Original Petition has been filed to direct the respondent police to grant an adequate police protection for putting up super structure over the petitioner's property to an extent of 585 Square Feet, comprised in Survey No.88/2C4A, Patta No.907, Situated at Konganapuram Village, Omalur Main Road, Edappadi Taluk, Salem District by initiating appropriate actions against the second respondent, based on the complaint given by the petitioner dated 10.05.2022 on the file of the first respondent police.

The learned counsel appearing for the petitioner submitted that though the petitioner gave complaint on 10.05.2022 with regard to fence his property to an extent of 585 Square Feet, comprised in Survey No.88/2V4A, Patta No.907, Situated at Konganapuram Village, Omalur Main Road, Edappadi Taluk, Salem District, the same has not been considered so far. Hence, the present petition has been filed.

3. The learned Government Advocate (Crl.Side) appearing for the first respondent submitted that the petitioner's complaint dated 10.05.2022 is not available with the first respondent. If any fresh complaint is given by the petitioner to the first respondent, they are ready to take action upon the complaint given by the petitioner.

4. I have considered the matter in the light of the submissions made by the learned counsel for the petitioner and the learned Government Advocate (Crl.Side) appearing for the respondent.

5. Recording the submission made by the learned Government Advocate (crl.side), the petitioner is directed to give a fresh complaint to the first respondent. On receiving the same, the respondent is directed to consider the fresh complaint given by the petitioner and provide police protection on merits and in accordance with law, within a period of four weeks from the date of receipt of a copy of this order.
