PETITION FOR ANTICIPATORY BAIL Under Sec. 438 Cr.P.C. ORDER : The Court Made the following order :- The petitioner who apprehends arrest by the respondent police for an offence under Sections 379 of I.P.C and Section 3(1) of Prevention of Damage to Public Property Act, 1984 in Crime No.339 of 2021, seeks Anticipatory Bail.
2. The case of the prosecution is that the petitioner was involved in illegal transportation of river sand theft.
3. It is seen from records that this is the third Anticipatory bail petition filed by the petitioner. The previous orders, dismissing the Criminal Original petitions were passed by this Court.
4. The learned Government Advocate (Crl. side) submitted that there is no change in circumstances after the previous orders were passed on merits. Hence, the learned Government Advocate vehemently opposed to grant Anticipatory bail to the petitioner. https://hcservices.ecourts.gov.in/hcservices/

In view of the submission made by the learned Government Advocate, no change of circumstances arises for considering the third Anticipatory bail petition. Hence, this Criminal Original petition is dismissed.
