ORDER : The Court Made the following order :- The petitioner, who apprehends arrest for the alleged offence under Sections 7(5), 20(2) of Cigarette and other Tobacco Products Act 2003 r/w 328 of IPC in Crime No.302 of 2021, seeks anticipatory bail.
2. The case of the prosecution is that on 07.12.2021 when the respondent police and his subordinates were in routine patrol duty at Kuthandakuppam, Sanjeevanur, on receipt of secrete information, they proceeded to Pamandi Vattam at the Cow shed of one Ravi, on seeing the police party two persons were try to escape from there, however they were manages and caught hold A1 and made search from the shed and found 1. 49,100 packets of Hans, 2. 5760 packets of MDM gold, 3. 891 packets of Gold Swaget, 4. 570 packets of Vimal Pan Masala and recorded his statement reveals that he himself and this petitioners are brother and both were went to Athipalli, Bangalore, State of Karnataka through in their TATA Sumo Victa EX and purchased the prohibited Pan Masala from there and sold the same to A3 to A7, who are running petty shops in their village. 3. The learned counsel appearing for the petitioner submitted that the petitioner has not committed any offence as alleged by the prosecution and he has been falsely implicated in this case. Hence, he prays for grant of anticipatory bail.
4. The learned Additional Public Prosecutor submitted that all were illegally transported the tobacco products, still more accused yet to be secured. Hence, he vehemently opposed to grant anticipatory bail to the petitioner.
5. Considering the facts and circumstances of this case, all were illegally transported the tobacco products, still more accused yet to be secured, it needs detailed investigation, investigation is in initial stage, this Court is not inclined to grant anticipatory bail to the petitioner.
