PRAYER: Criminal Original Petition filed under Section 482 Cr.P.C., to modify the condition imposed in para 4 of the order dated 01.08.2022 in Crl.M.P.No.3709 of 2022 on the file of the Principal District & Sessions Judge, Coimbatore directing the Petitioner to "sign before the respondent police on every 1st working day of every English Calendar month at 10.00 a.m., till the filing of the charge sheet". ORDER
This petition has been filed seeking for modification of the condition imposed by the court below while granting anticipatory bail to the petitioner.
2. Heard the learned counsel for the petitioner and the learned Government Advocate (Crl. Side) appearing on behalf of the respondent and carefully perused the materials available on record.
3. The petitioner filed an anticipatory bail in CMP.No.926 of 2022 before the Principal District and Sessions Judge, Coimbatore. The petition was ordered on 02.03.2022 and one of the conditions that was imposed by the court below was that the petitioner must report before the respondent police daily twice at 10.00 am and 5.00 pm until further orders.
4. The petitioner thereafter filed an application seeking for modification of the condition in CMP No.3709 of 2022 and an order was passed on 01.08.2022, modifying the condition to the effect that the
3 Crl Op No.21167 of 2023 petitioner must report before the respondent police on the first working day of every month at 10.00 a.m., till the filing of charge sheet.
5. Learned Government Advocate (Crl. Side) appearing on behalf of the respondent submitted that the the petitioner is compling with the condition. It was further submitted that the investigation is pending.
6. Taking into consideration of the facts and circumstances of the case and also of the fact that the petitioner is complying with the conditions regularly from the year 2022 onwards, this Court is inclined to relax the condition imposed by the court below. Accordingly, the petitioner shall appear before the respondent police, as and when required pending investigation.
7. This criminal original petition is disposed of with the above terms.
