Respondents Petition filed under Article 226 of the Constitution of India praying to issue a writ of certiorarified mandamus calling for the records of the 1st respondent in Office Memorandum No.C/2016 dated 30.04.2016, quash the same and consequently direct the 1st respondent to declare that the petitioner has the requisite educational qualification as per UGC norms to hold the post of Assistant Professor in Political Science Department and consequently forbear the respondents from in any way disturbing the services of the petitioner.

ORDER
The writ petitioner was appointed with the qualification of Master of Philosophy in Political Science as Lecturer in Political Science in the first respondent on temporary basis by communication dated 18.08.2006. Thereafter, the Board of Selection had granted approval and the petitioner was appointed as Lecturer in Political Science Department on probation and later she was confirmed.

The Government had taken a stand to depute excess staff to other Government Colleges. The petitioner was deputed to Periyar Arts College at Cuddalore. They denied her appointment and refused to take her consequent to the fact that she had not completed Higher Secondary Course. The petitioner rejoined the first respondent on 01.03.2016. Thereafter, show-cause notice was issued.

Learned Standing Counsel, however, produces a copy of the order of the first respondent which was signed by the Registrar on 08.10.2020 but dated 05.10.2020 in University Order No.395/2020 (C). Let me extract the order in entirety:- "Dr.S.Suchitra Varma, Assistant Professor in Political Science, Department of Political Science & Public Administration is informed 2/4
that by considering her reply for the show cause notice 1st cited and provisions in Government Order Ms.No.107 P & AR (M) Department dated 18.08.2009 and approval of the Syndicate, further action on the said Showcause notice is hereby dropped on a condition that she should continue in the present stage / position till qualify in 10+2+3 pattern to become eligible for AGP movement / promotion, as per rules."

Thus, it is seen that the show-cause notice had been dropped. The petitioner should continue in the present post but there is an obligation on her part to qualify 10+2+3 pattern to become eligible for AGP movement / promotion, in accordance with the Rules.

It is informed by learned Standing Counsel that the writ petitioner had now acquired the necessary qualification. 6.
In view of above, no further orders need be passed and the writ petition stands disposed of. No costs. Connected miscellaneous petition is closed.
