The petitioner, who apprehends arrest for the alleged offence under Section 420 of IPC in Cr.No.551 of 2022, seeks anticipatory bail. 2.The case of the prosecution is that the defacto complainant is the original owner of the lorry. Due to his illness, he leased out his lorry to one Kannadasan/A1. It is alleged that A1 had sold his lorry to third party and he inturn sold to this petitioner herein for a sum of Rs.8,50,000/-. Hence, the complaint.

3.The learned counsel appearing for the petitioner submitted that the petitioner has not committed any offence as alleged by the prosecution and he has been falsely implicated in this case. He would further submit he is a bonafide purchaser and paid Rs.9 lakhs. Hence, prays for grant of anticipatory bail.

4.The learned Government Advocate (Crl.Side) submitted that the investigation is pending in this case and the accused not have been arrested. Hence, he opposed to grant anticipatory bail to the petitioner. https://www.mhc.tn.gov.in/judis

5. Considering the facts and circumstances of the case and also the fact that there is no progress in the investigation, this court is not inclined to grant anticipatory bail to the petitioner. Accordingly, the petition seeking anticipatory bail is dismissed.
