The petitioner, who was arrested and remanded to judicial custody on 15.05.2025 pursuant to a non-bailable warrant issued in P.R.C.No.32 of 2015 on 1/4

the file of the Judicial Magistrate, Sriperumbudur, in connection with Crime No.185 of 2014 registered for the offences punishable under Sections 302 & 308 of IPC, seeks bail.

The contention of the learned counsel appearing for the petitioner is that since the petitioner has not received any summons in P.R.C.No.32 of 2015 pending committal on the file of the Judicial Magistrate, Sriperumbudur, he failed to appear before the committal Court on 14.12.2016, thereby, the trial Court had issued a non-bailable warrant against him. He further submitted that the petitioner is ready to abide by any stringent condition that may be imposed by this Court. Hence, he prayed for the grant of bail to the petitioner. 3.

Learned Government Advocate (Criminal Side) appearing for the respondent opposed for granting bail to the petitioner stating that the petitioner was secured after a period of nine years pursuant to the non-bailable warrant issued against him in P.R.C.No.32 of 2015 and the case has been committed to the court of Sessions and it is pending before the Principal District and Sessions Court, Kancheepuram, in S.C.No.103 of 2025. There are 18 witnesses in this case and the respondent would be able to complete the trial at the earliest. Therefore, if the petitioner is released on bail, there is a possibility of him absconding and not available for trial.

Heard both sides and perused the materials available on record. 5.

Considering the facts and circumstances of the case, nature of allegations, submissions made by the learned counsels on either side and taking note of the prolong absence of the petitioner, this Court is not inclined to grant bail to the petitioner.

Accordingly, the Criminal Original Petition stands dismissed with a direction to the learned Judge, Principal District and Sessions Court, Kancheepuram, to complete the trial and deliver the judgment in S.C.No.103 of 2025 preferably within a period of six months from the date of receipt of a copy of this order.
