Prayer: Writ Petition filed under Article 226 of the Constitution of India praying to issue a Writ of Mandamus directing the respondents to grant 50% of pension as per Section 11(4) of Tamil Nadu Pension Rules, 1978 as her pension benefits by considering her representation dated 06.10.2023 within the stipulated time as fixed by this Court. This writ petition has been filed for the issue of writ of mandamus directing the respondents to consider the representation made by the petitioner on 06.10.2023 wherein the petitioner has requested the respondents to grant 50% pension as per Rule 11(4) of the Tamil Nadu Pension Rules, 1978.
2.Heard the learned counsel for the petitioner and the learned Additional Government Pleader for the respondents. 2/6
3.The case of the petitioner is that he was appointed as Anganwadi Worker in the year 1992. The petitioner completed a training course in the year 1999 conducted by the 1st respondent and thereafter in the year 2006, the petitioner was appointed as Village Health Nurse. The petitioner was also relieved from Anganwadi Service in the year 2006. The claim made by the petitioner is that for the period from 1992 to 2006, the petitioner is entitled for 50% pension as per the relevant rules under the Tamil Nadu Pension Rules. A representation was also made in this regard and the same did not evoke any response. It is under these circumstances, the present writ petition has been filed before this Court. 4.
Taking into consideration the facts and circumstances of the case and without going into the merits of the case, there shall be a direction to the respondents 1 & 2 to deal with the representation made by the petitioner on 06.10.2023 on its own merits and in accordance with law and final orders shall be passed within a period of eight (8) weeks from the date of receipt of a copy of this order.

5.The petitioner is directed to make a fresh representation to the respondents 1 & 2 along with all the relevant documents and also a copy of this order.
6.In the result, this Writ Petition is disposed of with the above directions. No costs.
