The Writ Petition (Criminal) has been filed seeking a direction to the first respondent to consider the petitioner's representation dated 27.06.2025.

2. Heard the learned counsel appearing for the petitioner and the learned Government Advocate (Criminal Side) appearing for the respondents.

The main grievance of the petitioner is that the fifth respondent, who is involved in a political party, is subjecting the petitioner under the caste biased discrimination from the year 2010 and no benefits have been extended to him in the village. Since the petitioner belongs to another political party, he had painted his party symbol on the outer wall, which gave rise to the present dispute. Thereafter, the petitioner and his family subjected to persistent verbal abuse, exclusion from village activities and threats. Though the petitioner has made several representations to the authorities, no action has been taken. Hence, the present petition has been filed before this Court.

4. On perusal of the entire records, it is seen that the allegations made are only against the fifth respondent who allegedly caused trouble on the ground of caste. If the petitioner had really been subjected to atrocities in the name of caste, the same would attracts the provisions under SC/ST Act. Therefore, the petitioner ought not to have waited all these years. Instead of merely sending representations to the first respondent, it would have been proper to approach the court concerned. If the petitioner had actually been subjected to such atrocities, he could have filed a private complaint before the Magistrate concerned, even if the respondent Police had not taken any action. Therefore, this court do not find any merits in this case.

5. Accordingly, this Writ Petition Criminal stands dismissed. No costs.
