Suman M Mathew v. Inspector Of Police
Crl.O.P.No.20976 of 2023 C.V.KARTHIKEYAN, J.
The petitioner who apprehends arrest at the hands of the respondent police for the offences punishable under Sections 465, 467, 468, 471 and 420 of IPC read with Section 34 of IPC in Crime No.736 of 2022, seeks anticipatory bail.
2.Even though the learned counsel for the petitioner insisted that an order should be passed, in view of the order passed by a Coordinate Single Judge of this Court in Crl.O.P.Nos.19233 and 16423 of 2023 by an order dated 12.09.2023, there is an order of stay granted of investigation in both the First Information Reports in Crime Nos.184 of 2021 and 736 of 2022.
3.Hence, this Court is of the opinion that granting or dismissing this anticipatory bail petition would not give any final solution to the petitioner. Accordingly, this criminal original petition stands dismissed. Whenever, the Court directs that the investigation could recommence, the petitioner may file a fresh petition seeking necessary relief. 04.10.2023 1/2 https://www.mhc.tn.gov.in/judis
