This writ petition has been filed to direct the 3rd respondent to consider and dispose of the petitioner's representation, dated 31.07.2023, within a stipulated point of time, fixing a time frame of one week, as he is counting the days and accept the petitioner's son S.Sujeeth only to receive all the terminal benefits after the petitioner's death. 2.It is the case of the petitioner that he is suffering from Cancer (Stage-4) and is counting his days. While so, the petitioner's wife and daughter have deserted him and therefore, the petitioner is inclined to nominate his son alone, namely, S.Sujith, born on 28.04.2004, to receive all his terminal benefits after his death. In this regard, the petitioner has given a representation dated 31.07.2023 to the respondents. Since the same has not been considered, the present writ petition has been filed. 3.Heard the learned counsel for the petitioner.
4.Mr.V.Jeevagiridharan, learned Additional Government Pleader, who takes notice for the respondents, submits that the representation of the petitioner has not been received by the office of the respondents and no such acknowledgment is also produced by the petitioner. He further submits that, if a fresh representation is submitted by the petitioner in this regard, the same will be considered by the respondents.
5.In view of the submission made by the learned Additional Government Pleader and considering the limited nature of relief sought for in the present writ petition, the petitioner is directed to submit a fresh representation to the respondents within a period of 10 days from today and on receipt of such representation from the petitioner, the respondents shall consider the same and pass appropriate orders, on merits and in accordance with law, within a period of one month thereafter. 6.With the above directions, this writ petition is disposed of. No costs.
