Respondents Petition filed under Article 226 of the Constitution of India praying for the issue of a writ of Prohibition, prohibiting the plying of Auto's in City of Chennai to avoid accidents and to effect free flow of traffic as Government is providing Transport buses and call taxies are plying on the roads for the public utility as per M.V.Act and Rules of 1989 under Section 115, keeping in mind the increased number of vehicles plying in the city. (The Order of the Court was made by The Hon'ble The Chief Justice) The prayer made is to prohibit the plying of Autos in the City.
2. None appears for the petitioner. The petitioner must have suffered at the hands of the auto rickshaw drivers where Government is doing little to control their undesirable actions, despite current directions of the court. That aspect is being monitored by us in a separate petition.
3. We may only note that the issue raised by the petitioner that excess persons being carried is also be required to be prevented by the police authorities.
4. The writ petition accordingly stands disposed of. No costs.
