O R D E R
The petitioner herein claiming ownership in respect of the property measuring to an extent of 324 Sq.mtrs., in Survey No.120/19 at Nathankaduvetty Village, Sennakunam Madura, Kandhachipuram Taluk, Villupuram District has filed a criminal complaint against the respondents 3 to 5 alleging illegal trespass and also given a complaint to the revenue officials to enquire into the matter and issue patta in their favour.
2. The case of the petitioner is that while the property is under the possession and enjoyment of the petitioner for more than 50 years, one Mr.Paavadai has fraudulently applied patta in his favour and transferred the property to his sons Ramesh and
Suresh vide sale deed dated 18.02.2016. In this regard a complaint has been given to the Revenue Divisional Officer and no action has been taken so far.
3. The learned Government Advocate states that pursuant to the representation given by the petitioner and notice received from the Court regarding the pendency of the present writ petition, the disputing parties were called for to appear for the enquiry and both the parties have entered appearance through their counsel and filed vakalat. The enquiry is in progress and the next date of enquiry is to be held on 25.11.2019. The learned Government Advocate would also submit that if the parties co-operate for the enquiry, it will be completed and orders will be passed within a period of four weeks.
4. Recording the same, this writ petition is disposed of with a direction to the petitioner and the respondents 3 to 5 to co-operate with the enquiry and complete the same within the time prescribed. No costs.
