Writ Petition filed under Article 226 of the Constitution of India to issue a Writ of Mandamus, directing the 1st respondent to consider and dispose of the petitioner's petition dated 25.11.2016.

O R D E R

The petitioner has filed the above Writ Petition to issue a Writ of Mandamus, directing the 1st respondent directing the 1st respondent to consider and dispose of the petitioner's petition dated 25.11.2016.

2. In the representation given by the petitioner dated 25.11.2016, he has requested the 1st respondent to cancel the registered sale deed following Circular No.67, dated 03.11.2011. https://hcservices.ecourts.gov.in/hcservices/

3. Mr.B.Kannan, learned Government Advocate, appearing for the respondents 1 and 2 submitted that since the Government had already withdrawn Circular No.67, no relief an be granted to the petitioner in the above Writ Petition.

4. It is pertinent to note that Circular No.67 was withdrawn by the Government on 08.11.2017. Since the Circular No.67 is not in existence, the petitioner cannot seek for cancellation of the registered document by the 1st respondent. The remedy open to the petitioner is only to file a Civil Suit before the competent Civil Court. In such view of the matter, the Writ Petition is closed. No costs.
