The learned counsel for the respondent would oppose based on the ground that the reasons stated for condoning the delay of 169 days is insufficient.

2. The learned counsel for the petitioner would submit that the appellants are aged about 75 and 70 years and therefore, there was a delay in approaching the counsel for the purpose of filing the present appeal.

3. However, the delay cannot be construed as enormous and thus, this Court is inclined to condone the delay of 169 days in filing the above appeal.

4. Accordingly, the Civil Miscellaneous Petition is ordered.
