(Order of the Court was made by K.K.SASIDHARAN,J.) This petition is filed to condone the delay of 494 days in filing the appeal.

2. We have heard the learned counsel for the petitioner and the learned counsel for the respondent, who has filed a counter opposing the prayer for condonation of delay.

3. The very same decree was challenged by the respondent herein in C.M.A.No.615 of 2018. In view of the pendency of the appeal filed by the respondent, we are of the view that the delay deserves to be condoned, so as to enable this Court to take up the entire matter on merits. Accordingly, the delay is condoned and the miscellaneous petition is allowed.
