ORDER

This Writ Petition has been filed for a direction directing the first respondent to open the Kannivadi Panchayat Weekly Market at 5.00 a.m. and close the same at 6.00 p.m.

2. Heard the learned Special Government Pleader appearing for the respondents. There is no representation on behalf of the petitioner. Therefore, this Court is inclined to pass orders on merits.

3. The petitioner is an agriculturist who submitted a representation seeking opening of the market at 5.00 a.m. and to close the same at 6.00 p.m.

4. A perusal of the counter filed by the third respondent and the submissions made by the learned Special Government Pleader for the respondents reveals that the Kannivadi Panchayat Weekly Market is being opened at 6.30 a.m. in the morning of every Friday. After opening of the gates, the toll lessee lets in vehicles one by one into the shandy after collecting his toll fee. After entering into the shandy, the traders

begin their trading by 8.00 a.m. as fixed by the local authority. Therefore, the representation submitted by the petitioner cannot be considered. Thus, the writ petition lacks merits and is liable to be dismissed.

5. Accordingly, this writ petition stands dismissed. No costs.
