ORDER

This Criminal Original Petition has been filed to direct the second respondent to transfer the Investigation in FIR in Crime No.450/2025 pending on the file of the third respondent to CBCID.

2. According to the petitioner, the complaint given by the petitioner has not been investigated by the investigating officer, since one of the accused is working in the Home Department. Therefore, the present petition has been filed seeking aforesaid direction.

3. The very allegation of the petitioner in the complaint indicate that it is purely a civil dispute and there are transactions between them. It is also stated in the complaint that a Civil Suit is pending between the parties. Hence, this Court is of the view that merely because the First Information Report has not been registered for the relief as required by the petitioner, it cannot be said that investigation has not been done. In such view of the mater, let the investigating Officer conduct investigation in a fair manner and register the First Information Report, only if any cognizable offence is made out and proceed as per law.

4. With the above observations, this Criminal Original Petition is dismissed.
