Respondents Prayer:- Writ petition filed under Article 226 of the Constitution of India praying to issue a Writ of Mandamus, to direct the 3rd and 4th respondents to consider the representation sent by the petitioner dated 02.04.2019 for getting arrears of salary of petitioner's son named T.Unnikrishnan(late) for the year 2012 and 2013 from 3rd and 4th respondents. By consent, this writ petition is taken up for final disposal at the admission stage itself.
2.The petitioner herein is the mother of one T.Unnikrishnan (late), who had retired from service in the year 2015 as Associate Professor in Vedantham from the 3rd respondent College. He died on 14.06.2015 without receiving his retirement benefits. He got divorced and therefore, he left his mother and his only daughter as his legal heirs. The petitioner herein had filed W.P.Nos.18855 of 2016, 25674 of 2017 and 3129 of 2018 and obtained retirement benefits and pension. However, later she came to know through RTI that his son was not paid with salary during the year 2012 and 2013. Therefore, she approached the respondents 2,3 and 4 and submitted representations on 02.04.2019, 09.05.2019 and 02.07.2019 seeking arrears of salary of her son for the year 2012 and 2013. But till date, the said arrears were not paid to her.
Hence, the petitioner has filed the present writ petition with the aforesaid prayer. 3.Heard Ms.P.Uma, learned counsel appearing for the petitioner and Mr.V.Kadirvelu, learned Special Government Pleader appearing on behalf of the respondents 1 and 2. 4.The learned counsel for the petitioner would submit that without going into the merits of the case, it would suffice if a direction is issued to the respondents 3 and 4 to consider the representation of the petitioner dated 02.04.2019 for getting arrears of salary of her son for the year 2012 and 2013 and pass orders, within the stipulated time as fixed by this Court. 5.The learned Special Government Pleader conceded to the submissions made by the learned counsel for the petitioner. 6.
Thus, without going into the merits of the case, this Court is inclined to direct the respondents 3 and 4 to consider the representation of the petitioner dated 02.04.2019 and pass orders on merits and in accordance with law within a period of twelve weeks from the date of receipt of copy of this order. 7.With the above direction, this writ petition stands disposed of. No costs.
