ORDER

The learned counsel for the petitioner states that all the respondents except the first respondent have been served and their names are also printed. Insofar as the first respondent is concerned, learned counsel states that despite having taken notice to the address shown in the arbitration proceedings, the same has been returned unserved as "no such person is available in the said address".

2. On verification of the records, I find that the petitioner has has taken notice through Court as well as privately to serve the first respondent at the address mentioned by the first respondent themselves before the arbitration proceedings. Further, the counsel who appeared for the first respondent is also printed in the cause list. However, there is no representation today on behalf of the first respondent either in person or through counsel.

3. The CMP has been filed seeking condonation of delay of 2 days in filing the CRP. Heard the learned counsel for the petitioner and I have also gone through the affidavit filed in support of the petition. The petitioner has satisfactorily explained the delay of 2 days and the delay is also not inordinate. Being satisfied with the reasons assigned, the application is allowed.

4. The Registry is directed to number and list the CRP for admission, if it is otherwise in order.
