ORDER
When the matter was taken up for hearing, learned counsel for the petitioner fairly submitted that during the pendency of the writ petition, the sole petitioner died. He further submitted that the period of lease and licence granted to the deceased petitioner has already over in the year 2017. However, he prayed that this Court may grant liberty to the legal heirs of the deceased petitioner, to work out their remedy in the manner known to law if they are having any grievance, in future.
2. This Court perused the available records.
3. This writ petition has been filed challenging G.O. Ms.No.233, dated 23.09.2015 with regard to prescription of procedures for permission to quarry Savudu Silt and Earth for other than bonafide domestic and agricultural purposes and subsequently, the Government decided to repeal the said order completely.
4. From the submissions of the learned counsel for the petitioner, it is evident that the sole petitioner died during the pendency of the writ petition and the licence period was also expired. Therefore, nothing survives for further 2/4
adjudication and considering that the writ petition is of the year 2017, this writ petition stands dismissed as abated, by recording the aforesaid submission. However, liberty is granted to the legal heirs of the deceased petitioner to work out their remedy, if any, in the manner known to law, in case if any cause survives in future. No costs. Consequently, connected miscellaneous petitions are closed.
