ORDER

This matter is listed under the caption for 'being mentioned' at the instance of learned counsel for the petitioner.

2. It is brought to the notice of this Court that some typographical error in para No. 4 & 6 of the order dated 02.03.2026 and same may be replaced as follows:

4. After completion of trial, on the basis of the written submissions filed by the plaintiff, the defendants had filed the application in I.A No. 5 of 2025 to send the documents for forensic examination for comparison of signature found in the Ex.B1 receipt with other documents, but two documents alone have been sent for comparison and report has also been received from the expert.

6. The learned counsel appearing for the petitioner would submit that originally the petitioner had requested to the send the receipt and other documents for forensic examination to compare the signature in the Power of Attorney and receipt, but the trial Court has not sent all the documents for expert opinion, only two documents have been sent for comparison and obtained the report. However 12 days after the execution of sale deed, power of attorney was cancelled. The receipt was also issued on the date of execution of the sale deed. Therefore, those documents have also to be sent for comparison of the signature of the first respondent in the document.

3. The Registry is directed to carryout above correction and issue fresh order copy to the parties.
