C.M.P.No.15828 of 2024 in C.M.A.Sr.No.116923 of 2023 R.HEMALATHA , J This Civil Miscellaneous Petition has been filed seeking to condone the delay of 62 days in preferring the Civil Miscellaneous Appeal.

2. Since the second respondent remained absent before the Tribunal and was set exparte, issuance of notice to the second respondent is dispensed with.

3. Though notice was served on the first respondent and his name is also printed in the cause list, there is no representation on his behalf.

4.Having satisfied with the reasons assigned in the affidavit filed in support of this petition, the miscellaneous petition is allowed and the delay of 62 days in preferring the above appeal is condoned.

5. Registry is also directed to number the main Civil Miscellaneous Appeal, if it is otherwise in order and list the same for admission in due course.
