Respondent/Plaintiff Prayer: Appeal against the Order of the and decree of the XVI Additional Judge, City Civil Court, Chennai, dated 22/03/2019 in A.S.No.274 of 2017 remanding bank to the trial court of the XV Assistant Judge, City Civil Court, Chennai dated 11/08/2017 in O.S.No.2831 of 2015. Decree: This Appeal coming on for hearing on this day upon perusing the petition of Appeal, the order of the Lower Court and the material papers in this case and upon hearing the arguments of Mr.G.Senthilkumar, Advocate for the Appellant and of not appearing in person or by advocate for the respondent and this Court while allowing the Appeal doth order and decree as follows:

1.that the judgment and decree of the XVI Additional Judge, City Civil Court, Chennai dated 22/03/2019 in A.S.No.274 of 2017 be and hereby is set aside; and the Appeal remanded 2.that the first appeal/appeal suit 274/2017 stands restored to the file of the XVI Additional Judge, City Civil Court, Chennai, in its Original number; 3.that the 1st Appellate Court shall proceed to dispose of the case as expeditiously as possible and preferably, within a period of six months by affording opportunity to all the parties on merits and in accordance with law; and 4.that there shall be no costs in this Civil Miscellaneous Appeal.
