Crl.O.P.NO.21591 of 2023 G.CHANDRASEKHARAN,J.

The petitioner, who was arrested and remanded to judicial custody on 30.03.2023 for the offences punishable under Section 294(b), 341, 506(ii), 307 of IPC in connection with Crime No.467 of 2019, seeks bail.

2. The learned counsel for the petitioner submitted that, petitioner is an accused in Spl.SC.No.155 of 2023. Since, petitioner did not appear before the Court, Non Bailable Warrant was issued against him on 31.01.2020 and petitioner was arrested on 30.03.2023. Since then, petitioner is in Judicial Custody. He further submitted that, petitioner would be very regular hereafter and thus, he seeks bail to the petitioner.

3. In response, the learned Additional Public Prosecutor opposes the petition on the ground that, apart from this case, there are 10 previous cases registered against the petitioner, while NBW was pending against him.

Considering the fact that, petitioner is an habitual offendor and there are 10 cases has been registered against the petitioner, while NBW is pending against him, this Court is not inclined to grant bail to the petitioner for the reason that, if the petitioner is released on bail, he will indulge in committing similar offence.

5. Accordingly, this Criminal Original Petition is dismissed. 20.09.2023 Sma 2/3
