Respondents Prayer :- Writ Petition filed under Article 226 of the Constitution of India praying for the issuance of a Writ of Mandamus, directing the Revenue Divisional Officer, Office of the Revenue Divisional Office, Arakkonam, Ranipet District, the 3rd respondent herein to consider the appeal dated 28.08.2020 preferred by the petitioner to cancel the pattas in patta Nos.120, 489, 156, 784 and 155 of Punnai Village, Nemili Taluk, Ranipet District granted in favour of the respondents 6 to 12 by
the 4th respondent, consequently grant the patta in the name of the petitioner in respect of the petitioner's own lands by affording reasonable opportunity of personal hearing to the petitioner as well as the respondents 6 to 12 and pass appropriate order on the appeal dated 28.08.2020 on merits in accordance with the rules and regulations of the official respondents within the time frame fixed by this Court. ORDER
This writ petition has been filed for issuance of Writ of Mandamus, directing the 3rd respondent herein to consider the appeal dated 28.08.2020 preferred by the petitioner to cancel the pattas in patta Nos.120, 489, 156, 784 and 155 of Punnai Village, Nemili Taluk, Ranipet District granted in favour of the respondents 6 to 12 by the 4th respondent, consequently grant the patta in the name of the petitioner in respect of the petitioner's own lands by affording reasonable opportunity of personal hearing to the petitioner as well as the respondents 6 to 12 and pass appropriate orders on merits and in accordance with law.
2. Heard, Mr. S.Srinivasan, learned counsel appearing for the petitioner and Mr. P.Baladhandayutham, learned Special Government Pleader appearing for the respondents 1 to 5.
3. The petitioner filed an appeal before the third respondent as against the issuance of patta in favour of respondents 6 to 12 herein and it is pending without even issuing any notice.
4. Considering the above, the third respondent is directed to conduct enquiry on the appeal filed by the petitioner dated 28.08.2020, after issuance of notice to the petitioner and the respondents 6 to 12, by giving them an opportunity of hearing and shall pass orders on merits and in accordance with law within a period of twelve weeks from the date of receipt of a copy of this order.
5. With the above direction, the writ petition is disposed of. No costs.
