For the petitioners land situated in S.Nos.764/7, 8 and 9 and 806/1B, Erode E Village, Rode to the extent of 98,764 sq.ft. together with interest from date of taking possession i.e., on 16.05.1995 to the petitioners. ORDER
The petitioners' lands were acquired pursuant to award No.1/95, dated 22.05.1995. In relation thereto, the petitioners were paid compensation at Rs.22/- per sq.ft. On the ground that other land owners covered by the same notification had been paid compensation at Rs.30/- per sq.ft., the petitioners had submitted a representation dated 25.06.2024 seeking differential compensation along with interest thereon at 15% per annum. The present writ petition relates thereto.
2. Learned counsel for the petitioner referred to the judgment of the Hon'ble Supreme Court in Valliyammal v. Special Tahsildar (Land Acquisition) and Another, (2011) 8 SCC 91 and pointed out that compensation was fixed at Rs.30/- per sq.ft. Learned counsel also submits that the proposal relating thereto was forwarded by the District Collector to the Revenue Divisional Officer on 22.07.2024. In spite of the lapse of more than a year, he submits that no action has been taken so far.
3. On behalf of the respondents, it is submitted that the Revenue Divisional Officer would pass orders on consideration of the petitioner's representation within two months from the date of receipt of a copy of this order.
4. By taking note of the above submissions, this writ petition is disposed of by directing the second respondent to consider the petitioners' representation dated 25.06.2024 and pass orders thereon within two months from the date of receipt of a copy of this order after taking note of the judgment of the Hon'ble Supreme Court in Valliyammal. A reasonable opportunity shall be provided to the petitioners before the order is issued. Consequently, connected miscellaneous petition is closed. No costs.
