Respondents Writ Petition filed under Article 226 of the Constitution of India, praying for issuance of a Writ of Habeas Corpus, directing the 2nd respondent to produce the petitioner's daughter minor Kaviarasi, aged about 16 years, before this Hon'ble Court from the custody of the 3rd respondent and hand over to the petitioner.

ORDER

(Order of the Court was made by S.M.SUBRAMANIAM,J.) The learned Additional Public Prosecutor would submit that the detenue Kaviarasi, aged about 16 years, is now staying at House of Peace Children's Home, Kudikadu, Veppur Taluk. The police authorities would submit that presently the detenue is not willing to join with her parents.

2. However, the learned counsel for petitioner states that the parents had already met the detenue and she is willing to join her parents.

3. If it is so, the petitioner is at liberty to meet the detenue in the Home and in the event of consent from the detenue, the authorities may initiate appropriate action permitting the detenue to go along with her

parents. Since the minor detenue is not in illegal detention, no further adjudication is required and the habeas corpus petition stands disposed of. Index : yes/no (S.M.S.,J.) (N.M.,J.) 24.09.2024 ss To
