JUDGMENT

(Judgment of the Court was pronounced by T.RAJA, J.) The First Appeal has been preferred against the judgment and decree passed in O.S.No.160/2012 by the learned IV Additional District Judge, Coimbatore.

When the matter was called, Mr.S.Mukunth, learned Counsel appearing for the appellant herein/plaintiff, on instructions, submitted that they filed a withdrawal memo before the Registry seeking permission to withdraw A.S.No.498/2017. A letter forwarded to the learned Counsel for the appellant dated 18.01.2021 signed by him and a Memo dated 21.01.2021 filed by the learned Counsel for the appellant seeking withdrawal of the Appeal have also been produced before this Court. 3.

Mr.N.Manokaran, learned Counsel for the 1st respondent and Mr.Rajendran Raghavan, learned Counsel for the 2nd respondent were also present before the Court.

Recording the Memo of Withdrawal, the A.S.No.498/2017 is dismissed as withdrawn. No costs. Consequently, connected Civil Miscellaneous Petition is closed.
