This application has been necessitated in view of the demise of the 2nd respondent. The suit is for partition.

2. Heard the learned counsel for the petitioner.

3. I have gone through the affidavit filed in support of this petition and being satisfied with the reasons stated in the affidavit filed in support of the petition, this Court is inclined to order this petition.

4. Accordingly this Civil Miscellaneous Petition is allowed.

Registry is directed to number the First Appeal, if it is otherwise in order and post the main case for admission.
