Petition filed under Article 226 of the Constitution of India to issue a Writ of Mandamus directing the respondents 1 to 3 to accord approval to the transfer and promotion of the petitioner, Sr.J.A.M. Valar Indira, as Headmistress in the fifth respondent St. Philomena's Girls Higher Secondary School, Tindivanam, Marakkanam Road, Villupuram District - 604 001, w.e.f.01.06.2024, within the same educational agency, as per the qualification prescribed in Annexure V(iv) under Rule 15(1) of the Tamil Nadu Private Schools (Regulation) Rules 1974, with all service and monetary benefits. Mr.S.Prabhakaran, learned Government Advocate takes notice on behalf of the respondents 1 to 4. Since this Court is not inclined to pass any adverse order as against the fifth respondent, notice to the fifth respondent is dispensed with. By consent, the writ petition is taken up for final disposal at the admission stage itself. 2/6

2.The petitioner has filed this writ petition seeking issuance of Writ of Mandamus directing the respondents 1 to 3 to accord approval to the transfer and promotion of the petitioner, Sr.J.A.M. Valar Indira, as Headmistress in the fifth respondent School, w.e.f.01.06.2024, within the same educational agency, as per the qualification prescribed in Annexure V(iv) under Rule 15(1) of the Tamil Nadu Private Schools (Regulation) Rules 1974, with all service and monetary benefits. 3.The learned counsel appearing for the petitioner would submit that the petitioner was appointed as Headmistress in the fifth respondent School. It is the further submission that proposal for appointment of Headmistress was forwarded to the respondents 1 to 4 for consideration vide proposal dated 29.10.2024 and such proposal is pending before the second respondent.

4.At this juncture, the learned Government Advocate would submit that the second respondent would consider the proposal of the fifth respondent according to its own merits and in accordance with law and pass orders, within a reasonable time. 3/6

5.In such view of the matter, without going into the merits of the writ petition, this Court deems it appropriate to direct the second respondent to consider the fifth respondent's proposal dated 29.10.2024 upon its own merits and in accordance with law and pass orders, within a period of eight weeks from the date of receipt of a copy of this order.

6.The writ petition is disposed of. No costs. Consequently, the connected miscellaneous petition is closed.
