ORDER

[Order of this Court was delivered by T.RAJA, J.] This contempt petition has been filed to punish the respondents for their willful disobedience of the order dated 09.12.2020 passed in W.P. No.17391 of 2020 and W.M.P. No.21561 of 2020. 2.A counter affidavit has been filed by the third respondent taking a stand that the petitioner was engaged on various dates as substitute in short term vacancies/leave vacancies for the various spells intermittently purely as outsider, whenever the regular MTS/ Postman availed leave and such engagement was without observing any recruitment formalities with clear understanding that this arrangement will be terminated at any time and that the substitute shall have no right to claim for appointment to the said post.

It is further stated in the counter affidavit that the petitioner had worked purely in the leave vacancies of regular MTS/Postman only by getting coolie charges as prescribed by the District Collectorate and therefore, he was not given any opportunity to serve as GDS since he was allowed to work in the leave place of Postman till 13.11.2021. 3.

a stand that the petitioner cannot be given any opportunity to serve as GDS as he was allowed to work in the leave place of Postman till 13.11.2021, we are of the considered view that prima facie there is no case made out for contempt. Accordingly, this Contempt Petition stands closed.
