Respondent Prayer : Writ Petition has been filed under Article 226 of the Constitution of India to issue a writ of Certiorarified Mandamus, calling for the records dated 15.09.2022 on the file of the respondent and to quash the same as illegal and unconstitutional, being violative of Article 19(1)(a) of the Constitution of India and consequently direct the respondent to grant permission to conduct the Public Meeting in Corporation Ground (Van Stand) near Old Bus Stand, Villupuram on any other day as requested by the petitioner.

ORDER

The Writ Petition has been filed to quash the proceedings dated 15.09.2022 passed by the respondent and direct the respondent to grant permission to conduct the Public Meeting in Corporation Ground (Van Stand) near Old Bus Stand, Villupuram on any other day as requested by the petitioner.

The learned counsel appearing for the petitioner submitted that in order to conduct Public Meeting on the date as requested by the petitioner in the Corporation Ground (Van Stand) near Old Bus Stand, Villupuram, the petitioner has sent a representation, dated 15.09.2022 to the respondent. The representation was rejected by the respondent police on the same day stating that the said meeting will create law and order problem. Hence, the present writ petition has been filed.

3. The learned Government Advocate (crl.side), appearing for the

respondent submitted that the representation of the petitioner dated 15.09.2022 was rejected by the respondent on the same day. If any fresh representation is given by the petitioner, they are ready to consider the representation of the petitioner.

4. I have considered the submission of the learned counsel appearing for the petitioner and the learned Government Advocate (crl.side) appearing for the respondent police.

5. It is brought to the notice of this Court that the Director General of Police, Tamil Nadu, Chennai, had issued a circular memorandum in Rc.007301/Genl.I(1)/2019, dated 09.04.2019, along with instructions to the Inspectors of Police throughout Tamil Nadu for consideration of applications seeking permission for conducting cultural programme. Therefore, in view of the detailed circular and guidelines issued by the Director General of Police, the respondent police is hereby directed to consider the fresh representation given by the petitioner and pass suitable orders based on the above said circular on merits, within a period of one week from the date of receipt of a copy of this order.
