Petition filed under Article 226 of the Constitution of India praying for issuance of Writ of Mandamus to direct the 9th respondent viz., the Registrar, Central Administrative Tribunal, City Civil Court Complex, High Court Buildings, Chennai - 104 to hear and decide O.A.No.00310/968/2019 on merits and in accordance with law within a time frame that may be stipulated by this Court.

ORDER

(Order of the Court was made by M.M.SUNDRESH, J.) Seeking a direction to the 9th respondent Tribunal to dispose of O.A.No.00310/968/2019 pending on its file, the present writ petition has been filed.

2.Heard the learned counsel appearing for the parties. 3.It appears from the submissions made and after going through the records that the order of compulsory retirement has been issued by the disciplinary authority as against the petitioner on 24.01.2020. In view of the same, nothing survives in this writ petition. However, a statutory appeal has been filed on 27.01.2020 by the petitioner to the Secretary, Department of Chemicals and Petrochemicals, Ministry of Chemicals and Fertilisers, Government of India, Shastri Bhavan, New Delhi.

4.In view of the above, we direct the aforesaid authority viz., Secretary, Department of Chemicals and Petrochemicals, Ministry of Chemicals and Fertilisers, Government of India, Shastri Bhavan, New Delhi to dispose of the appeal dated 27.01.2020, filed by the petitioner against the order dated 24.01.2020 passed by the first respondent, on merits and in accordance with law within a period of three months from the date of receipt of a copy of this order.

5.With the above direction, the writ petition stands disposed of. No costs. Consequently, connected miscellaneous petition is closed.
