Prayer:- Criminal Revision Case filed under Section 397 read with Section 401 of Cr.P.C, to call for the records in C.A.No.86 of 2017 on the XVII Additional Sessions Court, Chennai and set aside the judgment dated 23.11.2017 passed in C.A. No.86 of 2017 modified the order passed by the learned Metropolitan Magistrate Fast Track Court No.2, Egmore at Allikulam, Chennai -3, in CC.No.387 of 2013 dated 06.03.2017 convicting the Petitioner under Section 138 of the Negotiable Instruments Act and sentenced him to undergo Simple Imprisonment for one year and also directed the Petitioner to pay compensation a sum of Rs.8,96,000/- to the Respondent (Complainant).

ORDER

On 14.07.2023, the learned Counsel for the Revision Petitioner submitted that already he had arrived at a settlement with the Respondent. The learned Counsel for the Revision Petitioner has already paid a sum of Rs.1,00,000/- and a sum of Rs.2,00,000/- by way of Demand Draft which has been accepted by the Respondent. For the payment of the balance amount of Rs.2,00,000/-, the case is posted today, under the caption 'for reporting compliance'.

2. Today, 16.08.2023, the learned Counsel for the Revision Petitioner paid the balance amount of Rs.2,00,000/- by way of a Demand Draft and it has been accepted by the Respondent. The learned counsel for the Respondent filed a memo to that effect and the same has been recorded.

3. Based on the compromise arrived at between the parties, this Criminal Revision case is allowed by recording the compromise between the parties. The conviction and sentence imposed on the petitioner by the 2/4

learned XVII Additional Judge, City Civil Court, Chennai in Crl.A.No.86 of 2017 dated 23.11.2017 is set aside.
