ORDER

This Contempt Petition is filed to punish the respondent for the wilful disobedience of the order dated 29.04.2022 passed by this Court in W.M.P.No.10722 of 2022 in W.P.No.11131 of 2022.

2. On 29.04.2022, at the time of admission, this Court has passed an interim order, based on the undertaking given by the learned counsel appearing for the first respondent University that the pension and gratuity amount will be settled to the petitioner.

3. A counter-affidavit is filed in this Contempt Petition by the first respondent. In paragraph 6 of the said counter-affidavit, it is stated that as follows:

"I state that on 12.09.2022 an order was passed by my office complying with the orders of this Hon'ble Court.

The order categorically sets out in detail that on account of financial loss caused to the university, as per clauses 18(5), 30 and 41, of the Pension Statutes of Anna University, the University is empowered to withhold payables to the petitioner.

However, as per Clause 40 of the pension statutes, a sum of Rs.1,02,370/- per month, is being paid as provisional pension until the adjudication of W.P.11131/2022, pending on the file of this Hon'ble Court.

4. Learned counsel appearing for the petitioner submits that the respondent has not complied the order passed by this Court as per Rules. Therefore, petitioner may be permitted to file appropriate application in the writ petition seeking further clarification.

5. In view of the above, the contempt petition is closed with liberty to the petitioner as sought for.
