O R D E R

This criminal revision case has been preferred against the order dated 01.07.2025 passed in CMP.No.2478 of 2025 on the file of

the Court of Judicial Magistrate No.II, Panruti, thereby dismissing the petition to return the vehicle.

Heard, the learned counsel appearing on either side and perused, all the materials placed before this Court. 3.

On perusal of records, it is revealed that the petitioner owned the vehicle bearing registration No.TN 31 CS 5666 Hyundai Venue, 1.2 Kappa MTS, Typhoon Silver. It was used by one of the accused for illegal transportation of liquor i.e. 12 Nos. of high stakes whiskey-each 750 ml, morpheus blue brandy-55 nos-each 500 ml and 170 Nos. of kingfisher tin beer-each 500 ml. It is seen that while intercepting the vehicle, the accused flew away from the vehicle. Thereafter, the vehicle was seized and also the accused was arrested. Subsequent to registration of FIR in crime No.107 of 2025 for the offences punishable under Sections 4(1)(A), 4(1)(B) and 14A of Tamil Nadu Prohibition Act, the vehicle was confiscated by order dated 25.05.2025. Therefore, the question of return of the vehicle does not

arise since the vehicle has already been confiscated. Therefore, this Court finds no infirmity or illegality in the impugned order. 4.

In view of the above discussion, this criminal revision case is dismissed.
