DATED: 26.10.2022

CORAM:

THE HONOURABLE Mr. JUSTICE S.SOUNTHAR C.R.P.No.3378 of 2022 V.Jeyakumar ... Petitioner Vs.

S.Murugan ... Respondent PRAYER: Civil Revision Petition filed under Article 227 of Constitution of India, pleased to fix a time limit for the speedy disposal of the R.C.A.No.19 of 2016 on the file of the learned Sub Court, Poonamallee, Thiruvallur District. For Petitioner : Mr.A.Saranraj For Respondent : No Appearance

O R D E R

This Civil Revision Petition has been filed seeking a direction to the learned Rent Control Appellate Authority, (Sub Court) Poonamallee to dispose of Rent Control Appeal in R.C.A.No.19 of 2016 within a time frame.

2. Having regard to the limited prayer made by the revision petitioner in this revision, this Court is inclined to dispose of the Civil Revision Petition even without notice to the respondent.

3. The petitioner/landlord filed a petition seeking eviction of respondent on the grounds of demolition and reconstruction and obtained an order of eviction. The said order was challenged by the respondent in R.C.A.No.19 of 2016 before the Rent Control Appellate Authority, Poonamallee, and the same is pending from 2016.

4. A perusal of the E. Court entry furnished in the typed set of papers would suggest that the Rent Control Appeal has been adjourned from 23.10.2017 onwards awaiting for records from the Rent Controller without any substantial progress. Therefore, this Court is inclined to issue a direction the Court below to dispose of the Rent Control Appeal within in a period of four months from the date of receipt of copy of this order. Accordingly, this Civil Revision Petition is disposed of. No costs.
